TAMPA - Wilbesan Charter School is asking a judge to prevent the Hillsborough School Board from permanently closing the school, which was shut down by the county fire marshal last week.
Winter Garden attorney William Santana, representing Wilbesan, is seeking a temporary injunction to keep the board from severing the 2-year-old charter school's contract today, as recommended by superintendent MaryEllen Elia.
Santana says Elia overreacted to the fire violations, which were were not life-threatening.
"Her actions has created chaos in the lives of Wilbesan students and staff," Santana wrote.
Wilbesan opened on the first day of school Thursday with 23 students despite a cease and desist order issued by the county fire marshal the day before.
School officials have been working with Wilbesan parents to transfer its 37 enrolled students to other campuses.
The school was beginning its third year of serving fifth- to eighth-graders in east Tampa in a new facility on 78th Street.
